|---|---|
| Title | Bute Estate to Western Ground Rents Ltd conveyance of reversion, with plan |
| Date of document | 1938 |
| Type | deed |
| Evidence label | PRIMARY DOCUMENT — NOT PUBLISHED HERE |
| Repository / reference | Not yet disclosed by the bodies that should hold it: Vale of Glamorgan Council deed wallet 1756 (2 of at least 10 documents disclosed, FOI 00211027); no copy found in the catalogued Bute papers at Glamorgan Archives; HM Land Registry titles WA3996 and WA7355 not yet copied |
| Status | PENDING — Disclosure awaited. Named as root of title in the 1965 contract (EV-0216); next step is disclosure of wallet 1756 documents 1–3 and 5–9 and HM Land Registry official copies of WA3996 and WA7355. No cost stated. |
| Provenance | A “Conveyance on sale dated 25th December 1938” is recited as root of title in the 1965 school-site contract supplied by the Vale of Glamorgan Council under FOI 00211027 (EV-0216). That contract is Document No. 4 of Glamorgan County Council deed wallet 1756; the Vale has disclosed 2 of at least 10 documents in that wallet. No copy of the conveyance has been found in the catalogued Bute estate papers at Glamorgan Archives. HM Land Registry titles WA3996 and WA7355 (1964) are the registry files most likely to recite it (our inference); official copies not yet obtained. Status as at 30 October 2026. |

About this page type → Read the Docs
Proves: Not yet disclosed, so nothing yet. Reported: documented as fact that in 1938 the Bute Estate conveyed its reversion on the 1916 tenancy to Western Ground Rents Ltd, with a plan; Deed itself unexamined.
Does not prove: Does not establish the deed’s wording, schedule or plan extent, including whether Parcel A was included or excluded, or whether it was disclosed in the 1984–87 proceedings.
Interpretation: working hypotheses
Working hypotheses, kept apart from the record above. The record text on this page is unchanged. None of these is a finding: each line is labelled as inference, theory, a reading that cuts against the case, or a discarded theory, and names the evidence it rests on and what would confirm or refute it, so the reader can test it. Updated 25 Oct 2026 (v2: ingredients wording).
Relevance to the 29 October 2026 working theory. This conveyance and plan are a central control for the theory: the operative clauses and mapped extent must show whether WGR acquired a reversion only over Parcel B or any part of the house, woodland or south-eastern ground. The 1939 tenancy plan is not a substitute for this deed. An unlocated/undisclosed copy is a retrieval status, not proof of concealment. See the hypothesis and its tests.
Title chain and registration
THEORY · R-01Ground R5: the court's starting point — a Feb 1916 tenancy of "the whole of the farm" and BP's "paper title to the farm" — would fail for the farmhouse if the 1938 Bute → Western Ground Rents conveyance did not include it. The 1905 Bute conveyance and the 1924 drain agreement show Bute dealing with land here, so either the house came back to the main estate by a deed not yet seen, or the 1916 recital is loose.

Would be confirmed by: The 1938 conveyance plan showing the house parcel excluded.
Would be refuted by: The 1938 plan including it. Cuts against: paper title was not in issue in 1987 (E26), and the NLW 33-acre limeworks bundle (1876–1912) fits a letting that ended in 1912 rather than a sale (E43).
