GHF-E121 — 1938 Bute Estate → Western Ground Rents conveyance and plan

Source status: NOT YET DISCLOSED BY THE HOLDING PARTIES. The 1965 contract supplied by the Vale of Glamorgan Council (FOI 00211027) names a “Conveyance on sale dated 25th December 1938” as root of title. The Vale has disclosed 2 of at least 10 documents in the deed wallet that holds that contract; no copy has been found in the catalogued Bute papers at Glamorgan Archives; HM Land Registry titles WA3996 and WA7355 have not yet been copied. The actual deed and plan must be inspected before its legal extent is treated as established.

INFERENCE / PROVISIONAL RECONSTRUCTION — NOT A TRANSCRIPTION OF THE 1938 DEED

The current working reconstruction is that the 1938 instrument conveyed WGR the reversion associated with the earlier agricultural tenancy. The decisive question is what land the deed’s operative wording, schedule and plan actually include. Compare the 1916 tenancy, the 1939 tenancy plan and the Parcel A / Parcel B analysis. Until the source is examined, do not treat this inference as the deed’s actual wording or as final proof of the title boundary.

Evidence preview

Not yet disclosed. As at 30 October 2026, no party that should hold the 1938 conveyance or its plan has disclosed it. The next step is disclosure by the bodies listed below. An undisclosed copy is a retrieval status, not proof that the deed is missing. The parcel scope and exact legal effect remain subject to examination of the deed, schedule and plan.

1. The evidence

Evidence object area: who should hold the conveyance and plan, and what each has disclosed so far:

  • Vale of Glamorgan Council (successor to Glamorgan County Council): deed wallet No. 1756. FOI 00211027 (reply 14 Sep 2026) disclosed Document No. 4, the 1965 school-site contract whose condition F names “a Conveyance on sale dated 25th December 1938” as root of title (EV-0216), and Document No. 10, the 1965 conveyance. Documents 1–3 and 5–9 (at least eight more) have not been disclosed.
  • Glamorgan Archives: no copy of the conveyance has been found in the catalogued Bute estate papers (DBDT handlist searched). The handlist does show a December 1938 counterpart lease from WGR to Mountjoy Limited (DBDT11/1), but no conveyance.
  • HM Land Registry: titles WA3996 and WA7355, first registered in 1964 out of a 1938 root (our inference), are the registry files most likely to recite the deed’s parties and parcels. Official copies and any retained first-registration documents have not yet been obtained.

Description

3. What is not known

2. What is known

Catalogue: GHF-E121 · Type: Conveyance of reversion with plan · Date of document: 1938; a “Conveyance on sale dated 25th December 1938” is the root of WGR’s title in the 1965 school-site contract (EV-0216). That it is this Bute–WGR conveyance is likely (press: completion 23 Dec 1938) but the 1965 contract does not name the vendor · Expected holders: Vale of Glamorgan Council (deed wallet 1756, partly disclosed); HM Land Registry (WA3996, WA7355); not yet disclosed · Evidence status: PLACEHOLDER disclosure awaited

DOCUMENTED FACT. In 1938 the Bute Estate conveyed its reversion on the 1916 tenancy to Western Ground Rents Ltd (1938–39).

  • Its exact operative scope and plan. It is not assumed to exclude Parcel A until read, and it is not assumed to include it.
  • Whether any instrument in the record conveys Parcel A to WGR. None has been identified; the only WGR tenancy plan seen (DBDT123/7) shows Parcel B only.
  • Whether it was disclosed in the 1984–87 proceedings.

Interpretation and wider context

UNRESOLVED. If Bute could convey only what it still owned, this document and its plan decide whether WGR ever held Parcel A. 🕒

Relevance to the 29 October 2026 working theory. This is a central title-chain test: the original conveyance, schedule and plan must show exactly what Bute conveyed to WGR and whether the described estate includes Parcel B only or any of the house, woodland or south-eastern ground claimed as Parcel A/A1/C. The 1939 tenancy plan is not a substitute for the 1938 deed. That the deed has not yet been disclosed is a retrieval status, not proof of concealment or of its extent. See the hypothesis and its tests.

Interpretive assessment date: 10-10-2026.

High-level Cedwyn Estate theory cross-reference: The 1938 Bute–WGR conveyance is a control document for the proposed theory: its operative description and plan must establish whether WGR acquired Parcel B alone, the house/woodland/green, or a different estate. The 1939 tenancy plan is relevant to tenancy extent but is not a substitute for this conveyance. A verified exclusion or inclusion of a particular polygon would be more evidence on that precise question. Read the Cedwyn Estate Working Theory.

Interpretation: working hypotheses

Working hypotheses, kept apart from the record above. The record text on this page is unchanged. None of these is a finding: each line is labelled as inference, theory, a reading that cuts against the case, or a discarded theory, and names the evidence it rests on and what would confirm or refute it, so the reader can test it. Title chain and registration

THEORY · R-01Ground R5: the court's starting point — a Feb 1916 tenancy of "the whole of the farm" and BP's "paper title to the farm" — would fail for the farmhouse if the 1938 Bute → Western Ground Rents conveyance did not include it. The 1905 Bute conveyance and the 1924 drain agreement show Bute dealing with land here, so either the house came back to the main estate by a deed not yet seen, or the 1916 recital is loose.

Would be confirmed by: The 1938 conveyance plan showing the house parcel excluded.

Would be refuted by: The 1938 plan including it. Cuts against: paper title was not in issue in 1987 (E26), and the NLW 33-acre limeworks bundle (1876–1912) fits a letting that ended in 1912 rather than a sale (E43).
